This Privacy Policy describes and explains how DELiBER handles the collection, processing, usage and storage of the collected personal data. These data are acquired from the consumers, the merchants and the riders, who are also the users of the mobile device application (“DELiBER”, “DELiBER Driver”) and the website ("deliberexpress.com").

This policy ensures that DELiBERs’ processing of personal data is in accordance with Republic Act 10173 – Data Privacy Act of 2012.

    • II. Personal Data Collection and Processing

    The collection of personal data varies on who the user is and whether it uses the mobile or the web application.

    Consumers, in order to avail of the service, need to register thru the “DELiBER” mobile app. Personal data is requested by the mobile app and encoded by the user.

    Merchants, fill up application forms (online or physical) with their personal data which is then encoded and validated on the system by DELiBER support staff.

    Drivers, fill up application forms with their personal data and requirements which is then encoded and validated on the system by DELiBER support staff

    Automatically collected data

    In addition, the mobile application may collect the device’s location automatically. It also collects authentication token that is used for the authentication

    III. Personal Data Usage

    DELiBERs’ purpose for the collection and processing of are of follows:

    1. To validate the identification of the merchant
    2. To validate the identification of the rider
    3. To confirm an order or service
    4. To make adding Contact Person / Number easier
    5. To notify consumers of promotions on products and services
    6. To notify consumers, merchants and riders of DELiBERs official announcements
    7. To notify the consumer on confirmation of acceptance of the service by the riders
    8. To notify the consumer on confirmation of acceptance of the merchant for the order
    9. To notify the rider of the service request
    10. To notify the merchant of the consumer order request
    11. To notify the consumer completion of the service or orders
    12. To notify the merchant of the completion of the transaction

    IV. Sharing personal data with Third Parties

    DELiBER may engage with a third party for the purpose of integration between two existing systems. DELiBER ensures that the third party also applies its own privacy policy in accordance with the Data Privacy Act of 2012. Non-disclosure agreement is also in place between DELiBERs and the third party.

    DELiBER will ensure that it will not sell the Consumers, Merchants and Riders personal data. DELiBER will not share the Consumers, Merchants and Riders data for research purposes.

    V. Data Storage

    Consumers, Merchants and Riders collected personal data and other process data will be stored on an cloud storage platform, having the data being encrypted and secured to avoid unauthorized access. The cloud storage platform also has redundancy to ensured availability of data. A local copy of personal data is also periodically maintained on the physical location of DELiBERs main office. Only those who are authorized are allowed to have access to the said data, stating the purpose and date time access which are logged.

    Consumers, Merchants and Riders personal data will be maintained perpetually as long as it serves is purposes.

    VI. Requested Permissions

    The DELiBERs' mobile app requests the user’s device permission for the following:

    1. 1. Location Services – used for the purpose of the following:
      1.1 Showing of relevant content particularly merchants on the vicinity of the consumer
      1.2 As a reference for the merchant on the acceptance of the orders
      1.3 As a reference for the driver of the consumer’s service reque 2. Contacts Services – used for the purpose of the following:
      1.1 Making adding of Contact Person and Number easier in placing Pabili Orders
      1.2 Making adding of Contact Person and Number easier in placing Padala Orders
